Based on Article 13 of the Swiss Federal Constitution and the data protection regulations of the Swiss Confederation (Data Protection Act, DSG), every person has the right to protection of their privacy as well as protection against misuse of their personal data. The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations as well as this data protection declaration.

In cooperation with our hosting providers, we make every effort to protect the databases as well as possible against unauthorised access, loss, misuse or falsification.

We would like to point out that data transmission on the Internet (e.g. communication by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.

  • lit. d) Processing of personal data in order to protect the vital interests of the data subject or another natural person.
  • lit. f) Processing of personal data in order to protect the legitimate interests of us or of third parties, provided that the fundamental freedoms and rights and interests of the data subject do not prevail. Legitimate interests are in particular our business interest in being able to provide our website, information security, the enforcement of our own legal claims and compliance with Swiss law.

We process personal data for the duration required for the respective purpose or purposes. In the case of longer-term retention obligations due to legal and other obligations to which we are subject, we restrict processing accordingly.

Data protection declaration for newsletters

By subscribing to our newsletter, you agree to the receipt and the procedures described below. If you would like to receive the newsletter offered on this website, we need an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter . Further data is not collected. We use this data exclusively to send the requested information and do not pass it on to third parties.

Content of the newsletter

We only send newsletters, emails and other electronic notifications containing (advertising) information (hereinafter “newsletter”) with the consent of the recipient or legal permission. If the contents are specifically described when registering for the newsletter, they are decisive for the user’s consent.

Double opt-in and logging

Registration for our newsletter takes place in a so-called double opt-in process. This means that after registering you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can log in with someone else’s email address. Registrations for the newsletter are logged in order to be able to provide evidence of the registration process in accordance with legal requirements. This includes storing the registration and confirmation times as well as the IP address. The changes to your data stored at MailChimp are also logged.

Use of the shipping service provider “MailChimp”

The newsletter is sent using “MailChimp”, a newsletter delivery platform from the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in this information, are stored on MailChimp’s servers in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp can use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and presentation of the newsletter or for economic purposes to determine which countries the recipients come from. However, MailChimp does not use the data of our newsletter recipients to write to them ourselves or to pass them on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU/US-Swiss data protection agreement “Privacy Shield” and is therefore committed to complying with Swiss and EU data protection regulations. We have also concluded a data processing agreement with MailChimp. This is a contract in which MailChimp undertakes to protect our users’ data, to process it on our behalf in accordance with its data protection regulations and, in particular, not to pass it on to third parties. Login details

To register for the newsletter, all you need to do is enter your email address. Optionally, we ask you to provide your first and last name as well as your activity. This information is only used to personalize the newsletter.

Statistical survey and analysis

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from MailChimp’s server when the newsletter is opened. As part of this retrieval, technical information is initially collected, such as information about the browser and your system, as well as your IP address and the time of retrieval. This information is used to technically improve the services based on the technical data or the target groups and their reading behavior based on their access locations (which can be determined using the IP address) or access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our nor MailChimp’s intention to monitor individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Online access and data management

There are cases in which we direct newsletter recipients to MailChimp’s websites. For example, our newsletters contain a link with which newsletter recipients can access the newsletter online (e.g. in the event of display problems in the email program). Furthermore, newsletter recipients can subsequently correct their data, such as their email address. Likewise, MailChimp’s privacy policy is only available on their website.

In this context, we would like to point out that cookies are used on MailChimp’s websites and that personal data is processed by MailChimp, its partners and the service providers used (e.g. Google Analytics). We have no influence on this data collection. Further information can be found in MailChimp’s privacy policy. We would also like to point out the possibility of objecting to data collection for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

Termination/revocation

You can cancel your receipt of our newsletter at any time, i.e. revoke your consent. This means that your consent to sending it via MailChimp and the statistical analyzes expire at the same time. Unfortunately, a separate revocation of sending via MailChimp or the statistical evaluation is not possible.

Note on legal bases in connection with the EU General Data Protection Regulation (GDPR)

If the data controller on this website is located outside the European Economic Area or Switzerland, Google Analytics data processing is carried out by Google LLC. In the context of the fulfilment of contracts, we use the payment service providers on the basis of the Swiss Data Protection Ordinance and, where necessary, Art. 6 para. 1 lit. b. EU-DSGVO. Furthermore, we use external payment service providers on the basis of our legitimate interests in accordance with the Swiss Data Protection Ordinance and, where necessary, in accordance with Art. 6 para. 1 lit. f. Order processing in the online shop with customer account

We process the data of our customers in accordance with the data protection regulations of the Federal Republic of Germany (Data Protection Act, DSG) and the EU-DSGVO, within the framework of the order processes in our online shop, in order to enable them to select and order the selected products and services, as well as their payment and delivery, or execution.

The data processed includes master data (inventory data), communication data, contract data, payment data and the persons affected by the processing include our customers, interested parties and other business partners. The processing is carried out for the purpose of providing contractual services within the scope of operating an online shop, billing, delivery and customer services. In this context, we use session cookies, e.g. for storing the contents of the shopping cart, and permanent cookies, e.g. for storing the login status.

The processing is carried out on the basis of Art. 6 Para. 1 lit. b (execution of order transactions) and lit. c (legally required archiving) DSGVO. Users can optionally create a user account, in which they can view their orders in particular. Within the scope of registration, the required mandatory information is provided to the users. The user accounts are not public and cannot be indexed by search engines, e.g. Google. If users have cancelled their user account, their data with regard to the user account will be deleted, subject to their retention being necessary for reasons of commercial or tax law in accordance with Art. 6 Para. 1 lit. c DSGVO. Information in the customer account shall remain until it is deleted and subsequently archived in the event of a legal obligation. It is the responsibility of the users to save their data in the event of termination before the end of the contract.

Within the scope of registration and renewed registrations as well as the use of our online services, we store the IP address and the time of the respective user action. The storage is based on our legitimate interests as well as those of the users in protection against misuse and other unauthorised use. As a matter of principle, this data is not passed on to third parties unless it is necessary for the pursuit of our claims or there is a legal obligation to do so in accordance with Art. 6 Para. 1 lit. c DSGVO.

Deletion takes place after the expiry of legal warranty and comparable obligations; the necessity of retaining the data is reviewed at irregular intervals. In the case of legal archiving obligations, deletion takes place after their expiry.
