General Terms and Conditions

Welcome to eco design home. We recommend that you read the following terms and conditions carefully before making a purchase from our online shop. If you have any questions, please contact our customer service department (see below) before placing an order.

General

The General Terms and Conditions (GTC) apply to all orders placed via the online shop of ecodesign home GmbH (seller) or directly with the seller and regulate the legal relationship between the seller and its customers (buyer). The masculine form of the term “buyer” also includes the feminine form (female buyer).

The version of the GTC valid at the time of the order shall apply. The seller reserves the right to change the GTC at any time without notice.

Prices

All prices are in Swiss francs (CHF) including value added tax. Ordered additional services that are subject to a charge, such as postal delivery or freight forwarding, will be listed separately in the shopping basket and on the invoice.

The price stated at the time of the order applies in each case. Prices are subject to change at any time. As a matter of principle, the seller adheres to the non-binding prices suggested by the manufacturer.

Offer

The seller’s offer is directed at buyers domiciled or resident in Switzerland. Buyers abroad are requested to contact the seller by e-mail if they wish to place an order.

The Seller’s offer is non-binding and is always subject to the suspensive condition of availability for delivery on the part of the Seller or one of its contractual partners. We reserve the right to make changes to the product range. Product information such as illustrations, technical data, etc. are partly based on manufacturer’s specifications and are non-binding. Accessories, decoration and the like shown in the product images are not part of the offer.

Order

The sending of an order is deemed to be a legally binding offer by the buyer to the seller to conclude a contract. Immediately after sending the order, the customer will receive an automatic confirmation by e-mail documenting that the order has been received by the Vendor. Orders with incorrect data, in particular incorrect or invalid e-mail address and/or postal address, will not be considered.

By sending an order in the online shop with mandatory prior confirmation of the checkbox “Order with costs”, the buyer expressly agrees to these GTC, whereby these become an integral part of the contract.

Conclusion of contract

The contract shall not be concluded until the seller has sent a written order confirmation by e-mail. The order confirmation must be checked carefully and any discrepancies must be notified to the seller without delay.

The conclusion of the contract is always subject to the suspensive condition of availability for delivery on the part of the vendor or one of its contractual partners. The seller accepts no liability in the event that ordered goods can no longer be delivered because they are no longer in stock or because no subsequent delivery is possible or because they are no longer produced. The seller is also free to refuse orders in whole or in part without stating reasons.

In all cases of non-delivery, the buyer will be informed and any payments already made will be refunded. Further claims are excluded.

Payment

Payments in the online shop must be made in Swiss francs. For a desired payment in Euro, do not use the order process in the online shop, but send an e-mail to the seller.

Payment by PayPal and cash in advance are accepted.

In the case of payment in advance, the invoice amount is to be transferred within 5 days of the order confirmation. Delivery will only take place after receipt of payment and the goods will not be reserved until payment has been received and may be out of stock in the meantime. If the payment deadline is not met, the seller may withdraw from the contract and charge the buyer a handling fee.

Delivery

Collection:

Subject to stock of goods and receipt of payment, the Buyer may collect the ordered goods from the Seller’s warehouse in 8045 Zurich at a date agreed in advance.

Orders, with the exception of custom-made products and special orders, which are not collected on time shall be deemed to have been cancelled. Payments already made will be refunded. The right to claim a handling fee and damages remains reserved.

Postal delivery:

As a rule, delivery is only made within Switzerland. P.O. Box addresses are not delivered. Provided that the goods are in stock, the ordered goods are usually dispatched on working days within 3 to 5 days after receipt of payment.

Orders are delivered by Swiss Post by PostPac Priority (if necessary by Bulky Goods Priority) and usually reach the buyer on the following working day after posting. Depending on the size and weight of the ordered goods, different postal rates are used. For individual products, delivery is included in the price.

After handover to Swiss Post, the buyer receives a dispatch confirmation by e-mail with a tracking number, if available.

Swiss Post is liable for damage, loss or incorrect delivery of a consignment up to a maximum of CHF 500.00. The buyer is responsible for any further insurance (possibly covered by household contents insurance).

Whenever possible, the seller uses recycled packaging material.

Freight forwarding/furniture transport:

Goods that are not suitable for postal delivery will be delivered by furniture transport. A percentage amount of 10% of the value of the goods will be charged for the forwarding agent in the online shop. If the actual transport costs subsequently turn out to be significantly lower, the buyer can request reimbursement of the difference from the seller.

The transported goods are fully insured by the seller or the forwarder.

The timing of the transport will be planned in detail between the seller and the buyer after receipt of the order or after receipt of payment or after completion of the goods.

The transport is usually carried out with one man and with delivery to the kerb. Not included in the price are any other services, such as unpacking and assembling the goods, taking back old goods, disposing of packaging material, etc. The buyer is responsible for bringing the goods to the final destination. The delivery address must be easily accessible by truck. For delivery addresses without an access road or difficult access, delivery will be made to the nearest access point or railway station.

On request, delivery to the final destination, optionally combined with further services (unpacking, assembly, disposal, etc.), is offered. For this purpose, and in order to generally obtain the best possible and most favourable price, do not use the order process in the online shop, but send an e-mail to the seller.

The obtaining of permits, the provision of extraordinary auxiliary equipment (e.g. facade lift) or on-site adjustments are the responsibility of the buyer. All additional costs incurred which were not foreseeable and included in the calculation are to be borne by the buyer.

Delivery periods

All production and delivery times stated in the online shop are non-binding guidelines. They begin to run from the time of order or receipt of payment. The buyer will be notified of any significant delays in delivery. Delays in delivery do not entitle the buyer to cancel the contract or to a refund of the purchase price or part thereof. Any liability on the part of the Seller for any delay in delivery or (partial) failure to deliver for circumstances for which it is not directly responsible is hereby excluded. Any requests by the buyer for delivery on a specific date are non-binding.

If the buyer is in default of acceptance of the goods (e.g. non-delivery of the goods for reasons for which the buyer is responsible; non-acceptance of the ordered products on the agreed delivery date), the seller shall be entitled to deposit the goods owed at the buyer’s expense and risk and thereby release himself from his obligation. In addition, in the event of default in acceptance, the Seller shall be entitled to sell the goods elsewhere or to take them back. The buyer is fully liable for the damage incurred (including product costs, delivery and storage costs, other expenses) and must pay compensation to the seller.

Right of return / right of withdrawal

A return due to dislike or change of mind is possible within 14 days after collection or receipt without giving reasons, but only for goods purchased from the seller’s stock. If the customer cannot produce the delivery or receipt confirmation, the 14-day period begins with the dispatch of the order.

Excluded from the right of return (but not from warranty claims) are:

  • goods that are not marked with “available immediately, from stock in Zurich”, but must first be ordered from the manufacturer;
  • custom-made products, i.e. goods to be manufactured to order;
  • goods already in use.

The buyer must contact the seller in writing by e-mail within the deadline in order to register the return. If the buyer returns the goods in their original packaging, undamaged, clean and complete and enclosing the purchase receipt, the payment made will be refunded within 14 days after deduction of any services already rendered (in particular postage or transport costs).

As a rule, the return must be made in the same way as the receipt. All returns are at the expense and risk of the buyer. Returns can be taken to the seller’s warehouse in 8045 Zurich free of charge by prior arrangement.

An order or purchase can also be cancelled without any costs being incurred as long as the order has not yet been processed. The Seller shall make the final decision as to whether the revocation has been received in time. In this case, the order will be cancelled by the seller as a gesture of goodwill.

Warranty/guarantee

The Seller guarantees that the purchased goods are free of defects and functional for the statutory warranty period of 2 years from receipt.

Minor deviations of the received goods in terms of colour, design, workmanship and structure from the products depicted in the online shop cannot be claimed as defects.

The buyer must inspect the ordered goods immediately upon receipt and complain about any defects or deviations from the order immediately – but no later than 48 hours after receipt of the goods – in writing by e-mail to the seller. Only hidden defects can be claimed later. The buyer must report these immediately after their discovery, otherwise the goods are deemed to be accepted.

Excluded from the warranty are damages for which the buyer is solely responsible, e.g. as a result of improper use or assembly, use of unsuitable cleaning agents and/or methods, excessive stress, incorrect storage (e.g. outdoors or in a damp environment), natural wear and tear or external influences.

The seller is not liable for defects that the buyer knew or should have known about at the time of purchase. This applies in particular to special offers, exhibition and second-hand goods.

In the event of justified complaints, the seller shall decide whether a free repair, an equivalent replacement or exchange, a price reduction or a refund of the purchase price will be made. Further claims are excluded.

Liability

The seller is only liable for direct and immediate damage caused intentionally or by gross negligence. It shall not be liable for damage not caused to the goods themselves, in particular not for consequential damage, loss of profit or other financial losses of the buyer.

The product liability remains reserved. In this context, the seller points out that some of the products offered by the seller may have rough or sharp edges in certain places due to the material used, which may cause damage to clothing and possibly also to the body. The seller asks the buyer to take special care with these products.

Transport damage: Consignments which show the slightest trace of damage on arrival must be claimed immediately from the relevant service provider (post office or carrier) and a damage confirmation message issued by them.

All transport damage must also be reported immediately to the seller, with photos of the damaged packaging and the damaged goods. All parts of the original packaging must be retained.

Data protection

The Seller shall comply with the provisions of the Swiss Data Protection Act and the relevant legal standards in the collection, processing and use of personal data. Reference is made to the detailed data protection declaration.

Copyrights / Intellectual Property Rights

The sole right of use of these GTC belongs to the Seller. All intellectual property rights, in particular copyright (and related rights), to the online shop and the website are the sole property of the seller or the respective rights holders. Images, texts, logos, files etc. may only be downloaded or copied for personal use. Use for public commercial or other commercial purposes is not permitted without the prior express written consent of the seller or the respective copyright holder.

Applicable law and place of jurisdiction

These GTC and all rights and obligations arising from contracts concluded under these GTC are subject to Swiss law.

The place of jurisdiction is Zurich.
